if you used a capture card to capture PS4 footage however, no such restrictions would exist because it essentially becomes more like fraps, only it's hardware instead of software. but it's still independent of the console and any outside control.
unless PC becomes a closed platform, it will never be able to control what you can and can't capture from your screen in regards to gaming or anything.
now, what is illegal is the download of a pirated copy of a game. THAT is against the law. that's where the legalities start and end in the situation you just gave.
now, you could ask "how would someone know if the footage you'd captured of a game was from a legally purchased copy or of a illegally downloaded copy?" and the answer most of the time is 'they wouldn't'
some developers put in specific visual "defects" as a form of anti piracy which would give the game away. for instance. quantum break had the player character wear an eye patch if the game was pirated. if that was recorded there is a clear visual identifier that the copy was illegally obtained. but the actual act of recording the game wouldn't even factor into the legalities aside from the way you ended up getting caught for piracy.
